Love & Marriage…and Your Wallet

I have blogged previously about talking to a lawyer before you marry. It will protect you and your assets, as well as any children you may have, in the event of a divorce. It will force you and your fiance to consider important questions and views on life prior to walking down the aisle. It is quick, it is easy and it should be completely painless.

Unless, like Michael Strahan, you have an incompetent attorney.

Strahan has been ordered to pay his ex-wife $15.3 million in keeping with the pre-nup signed prior to their marriage in 1999, plus hundreds of thousands in child support. The figure gives Jean Strahan more than 50% of his net worth, more than she would have been entitled to with no pre-nup in place.

This was a pre-nup presented by Strahan and his attorney the night before the wedding, a tactic generally reserved for agreements that will be less than fair to the spouse.

But Jean said yesterday that it was his own fault. Strahan himself devised the uneven distribution spelled out in a pre-nup.

“He and his lawyer wrote it and made me sign it the night before we got married,” Jean said. “We were, at the time, very much in love.”

She did not have adequate counsel, nor ample time to review the document. The tactic is so unethical that, had the terms been less favorable to her, the judge would likely have nullified the contract.

The moral of the story is simply this; when you hire a lawyer, be sure he is on your side.

The reason this comes to mind now? I just heard Strahan is engaged to Nicole Murphy, ex-wife of Eddie Murphy. I heard she took a large chuck of Eddie’s cash when they divorced.

We have a man who lost his fortune to divorce, engaged to a woman who took a man’s fortune in a divorce.

I hope Strahan has found a better attorney to write up his pre-nup this time…
